§ 10-66. Class B license.

  • (a)

    Authority. Class B licenses shall authorize the retail sale of alcoholic liquors for consumption on the premises, as well as other retail sales of alcoholic liquors, only to (i) bona fide members, (ii) families of members and (iii) guests of a specific member when in the company of said member, in any club as defined in Section 10-1. Under a Class B license, the sale of alcoholic liquor for consumption on the premises to nonmembers is permissible only as set forth in this Section.

    (b)

    Display of notice. The holder of a Class B license shall prominently display on the premises and near each entry into the area where alcoholic liquors are sold to members, a sign which informs the public as follows:

    ATTENTION NONMEMBERS: This club holds a Class B liquor license. Except when club facilities have been rented or the Liquor Commissioner has issued a Special Event Permit, it is a violation of the conditions of that license for nonmembers (other than families of members or guests of a specific member when in the company of said member) (1) to be sold alcoholic liquors for consumption on the premises or (2) be in the area where alcoholic liquors are sold for consumption on the premises.

    (c)

    Rental of facilities. In the event the facilities of a club are rented for a fee to a person or organization for a wedding reception, family reunion or other social gathering not having a pecuniary purpose, then during the time the person or organization is actually utilizing the club facilities pursuant to such rental, the sale of alcoholic liquors for consumption on the premises shall be permitted to nonmembers in attendance at such social gathering. The presence of nonmembers in that area where alcoholic liquors are sold to members at any time when the facility is not actually being utilized pursuant to such rental shall constitute a violation of this Chapter by the license holder.

    (d)

    Special Event Permit. The Commissioner may issue a Special Event Permit for the retail sale of alcoholic liquor for consumption on the licensed premises to a Class B license holder. Such Special Event Permit shall be for a period of not more than 72 hours and shall be subject to such limiting conditions as the Commissioner deems appropriate. The licensee shall be permitted to obtain no more than ten Special Event Permits in any calendar year for the licensed premises. The licensee shall submit to the Commissioner an application containing such information as the Commissioner may require. There shall be no fee for a Special Event Permit. The applicant must make application to the Commissioner not less than 14 days prior to the beginning of the special event.
