§ 18-301. Definitions.

  • The following words, terms and phrases, when used in this Article, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:

    Barbed wire fence means any fence made of barbed wire or of which barbed wire forms any part.

    Corner side yard means that portion of open space on any corner lot, unoccupied and unobstructed by any buildings or structures, between these points:

    (1)

    The side of the main building on the lot facing the street, extended to the front and rear lot lines of the property; and

    (2)

    The street right-of-way contiguous to the lot on the side of the main building.

    Electric fence means an energized fence, electric or otherwise, that delivers a shock or other unpleasant stimulation when touched.

    Fence means any structure designed to create a barrier to the movement of humans or animals that is permanently or temporarily affixed to real estate and includes, but is not be limited to, structures made of chainlink, chain or wire mesh, wood, wood-picket, stone, concrete, block, brick, vinyl, plastic or single wire suspended between two posts permanently or temporarily affixed to real estate.

    Front yard means that portion of open space on any lot, unoccupied and unobstructed by any buildings or structures, between these points:

    (1)

    The front of the main building located on the lot, extended to the side lot line; and

    (2)

    The street right-of-way contiguous to the lot in front of the main building.

    Privacy fence means any opaque fence, barring public view, including, but not limited to structures made of solid wood, brick, concrete, block or stone. The term shall not include picket or chainlink fences; provided, however, that chainlink fences with slats inserted will be considered privacy fences.

    Spite fence means any fence that is more than six feet high, regardless of the material from which it is constructed.
