§ 22-100. Definitions.

  • The following words, terms and phrases, when used in this Article, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:

    Curfew Ordinance means the law codified in Chapter 38, Article VIII, Division 4 of the Code.

    Dance means any event organized for the primary and predominate, but not necessarily the exclusive, purpose of presenting live or recorded music for dancing, whether indoors or outdoors. Dances do not include events held in establishments licensed to sell alcohol under Chapter 10 of the Code or facilities operated by a governmental agency.

    Designated Village Official means the Village Official designated by the Village Board from time to time to administer the provisions of this Article.

    Employee means any employee, agent, or security personnel of the teen club.

    Licensee means any person holding a teen club license.

    Minor means any person under the age of 17.

    Security personnel means any individual hired or otherwise retained by a teen club to provide security services at the teen club.

    Teen club means any building, part of a building, or other enclosed place, including but not limited to a patio, deck or an outside enclosed area, within the Village limits where a teen dance is held or dancing involving individuals under the age of 19 years old is permitted, but shall not include (1) an accredited public or private school; (2) property owned or controlled by the federal, state or local government; or (3) a facility operated by an organization which has been recognized as exempt from federal income taxation as a religious organization under Subsection 501(c)(3) of the Internal Revenue Code of 1986, as amended.

    Teen club license means a license issued by the Village on an annual basis in accordance with the requirements of this Article which shall expire on April 30 of each year and shall not be transferable as to person or place.

    Teen club premises means the teen club and the private property owned, leased or otherwise controlled by the teen club's licensee that surrounds the teen club, including but not limited to the teen club's parking lot.

    Teen dance means a dance open to the general public or only to private membership to which persons under the age of 19 years are admitted.

    Village Appeal Board means three persons serving on the Village Regulations Committee or such other committee designated by the Village to hear appeals under this Article.
