§ 22-251. Definitions.

  • [The following words, terms and phrases, when used in this Article, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:]

    Secondhand dealer means any person which operates a business for profit which buys, sells, possesses on consignment for sale or trades jewelry, stamps, firearms, coins/currency, which may have been previously owned by a consumer; or which derives more than 35 percent of its gross receipts from the sale, consignment for sale, pledge or trade of any goods, wares or merchandise which have previously been owned by a consumer, including, but not limited to, furniture, appliances, automobile parts and accessories, metals, whether in bulk or manufactured state, computers, computer parts or equipment, video/camera/stereo parts or equipment, electronic video consoles and games, videos, music, musical instruments, collectibles and memorabilia, sporting goods, bicycles, motorized tools/vehicles, tools, collectible artwork, firearms, including their accessories and ammunition. The term "secondhand dealer" shall include businesses commonly known as swap shop operators, retailers, stamp dealers, coin dealers and jewelers who purchase, trade and resell items from persons other than dealers and suppliers. The fact that any business does any of the following acts shall be prima facie proof that such business is a secondhand dealership:

    (1)

    Advertises in any fashion that it buys or sells secondhand or used items. Such advertisements shall include, but not be limited to, media advertisements, telephone listings, and signs whether on the exterior or interior of the business.

    (2)

    Devotes a significant segment or section of the business premises to the purchase or sale of secondhand or used items.

    Firearm means any gun, pistol, or any device, by whatever name unknown, which is designed or may be readily converted to expel a projectile by the action of an explosive or propellant, or by an expansion or escape of gas, or the component parts of the foregoing, or any combination of component parts either designed or intended for use in converting any device into a firearm as described in this definition. Firearm does not include:

    (1)

    Any weapon that fires a projectile by means of air pressure (pneumatic gun) or any spring gun;

    (2)

    Any safety device used exclusively for signaling or safety; and

    (3)

    Any device used exclusively for the firing of construction or industrial ammunition.
