§ 38-46. Theft of less than $300.00.

  • (a)

    Applicability. This Section applies to the theft of property having an aggregate value of less than $300.00.

    (b)

    Theft prohibited. No person shall commit theft within the Village. As used in this Section, a person commits theft when he knowingly:

    (1)

    Obtains or exerts unauthorized control over property of the owner;

    (2)

    Obtains by deception control over property of the owner;

    (3)

    Obtains by threat control over stolen property knowing the property was stolen;

    (4)

    Obtains control over stolen property knowing the property to have been stolen by another or under such circumstances as would reasonably induce the person to believe that the property was stolen, and:

    a.

    Fails to promptly notify the owner or Police Department of such possession;

    b.

    Intends to deprive the owner permanently of the use or benefit of the property;

    c.

    Knowingly uses, conceals or abandons the property in such manner as to deprive the owner permanently of such use or benefit; or

    d.

    Uses, conceals or abandons the property knowing such use, concealment or abandonment probably will deprive the owner permanently of such use or benefit; or

    (5)

    Obtains the permanent or temporary use of property, labor or services of another that are available only for hire by means of threat or deception or knowing that such use is without the consent of the person providing the property, labor or services.

    (c)

    Penalty. A person convicted of theft under $300.00 shall be fined an amount of $250.00 and not more than $500.00, and shall also make restitution to the injured party.
