§ 38-461. Laser pointers.

  • (a)

    Definitions. The following words, terms and phrases, when used in this Section, shall have the meanings ascribed to them in this Subsection, except where the context clearly indicates a different meaning:

    Laser pointer means any handheld device that contains a laser that emits an intense beam of light, including, but not limited to, Class 1, Class 2a, Class 2, Class 3a, and Class 4 lasers, as defined in 21 CFR 1040.10 or 21 CFR 1040.11.

    (b)

    Prohibited acts. It is unlawful for any person under the age of 18 years to possess a laser pointer. It is also unlawful for any person to transfer or sell a laser pointer to any person under the age of 18 years.

    (c)

    Penalties. The penalty for violation of this Section shall be a fine of not less than $250.00 nor more that $500.00.
