§ 38-350. Definitions.

  • The following words, terms and phrases, when used in this Division, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:

    Establishment means any privately owned place of business carried on for a profit or any place of amusement or entertainment to which the public is invited.

    Minor means any person under the age of 17 years.

    Official Village Time means Central Standard Time, except when Central Daylight Savings Time is in effect, in which case Central Daylight Savings Time applies.

    Operator means any individual, firm, association, partnership or corporation operating, managing or conducting any establishment, and, whenever used in any clause prescribing a penalty, operator, as applied to associations or partnerships, shall include members or partners thereof and as applied to corporations shall include the officers thereof.

    Parent means any natural or adoptive parent of a minor; a guardian or any adult person, 21 years of age or over, responsible for the care and custody of a minor.

    Public place means any public street, highway, road, alley, park, playground, wharf, dock, public building or vacant lot.

    Remain means to be at such place, loiter, idle, wander, stroll or play ball in or upon.
