§ 58-33. Applicability.

  • (a)

    This Article, requiring the submission and approval by the Village Board of preliminary and final subdivision plats, shall apply to all subdivisions and developments, except those described in Section 58-33.5, and except the following exempt subdivisions and developments:

    (1)

    Division or subdivision of land into lots of five acres or more which do not involve any new streets or easements for access;

    (2)

    Division of lots or blocks of less than one acre in any recorded subdivision which does not involve any new streets or easements for access;

    (3)

    The conveyance of parcels of land or interests therein for use as a right-of-way for railroads, utilities or pipe lines which do not involve any new streets or easements for access;

    (4)

    The conveyance of land owned by a railroad or other public utility that does not involve any new streets or easements for access;

    (5)

    The conveyance or dedication of land for highway or other public purposes or the vacation of land dedicated for a public use;

    (6)

    The sale or exchange of parcels following the division into no more than two parts of a particular parcel of land existing on July 17, 1959, and not involving any new streets or easements for access;

    (7)

    The division of a parcel of land into three or fewer lots; provided that each lot has frontage on and access to a dedicated right-of-way.

    (b)

    Notwithstanding the foregoing, the exempt subdivisions and developments shall be required to submit a final plat and construction plans and specifications (pursuant to and in accordance with Section 58-36(b)—(h), (j), (m) and (n), and Section 58-37, and to pay, at the time of filing of the final plat and construction plans and specifications, a nonrefundable plat review fee in the amount established from time to time by the Village Board. These exempt subdivisions and developments, while not otherwise subject to the provisions of this Article, shall comply with the remaining provisions of this Chapter and all other applicable Village ordinances.
