§ 70-95. Exceptions.

  • A vehicle is not eligible for impoundment if:

    (1)

    The vehicle used in the commission of an offense set forth in Section 70-91, was stolen at the time and the theft was reported to the appropriate law enforcement authorities after the theft was discovered, or reasonably should have been discovered; or

    (2)

    The vehicle was used in the commission of a weapons offense or an offense involving the possession or delivery of a controlled substance or drug paraphernalia and the vehicle was operating as a common carrier, including, but not limited to, taxicabs or buses, and the violation occurred without the knowledge of the person in control of the vehicle and the vehicle's owner of record.
