§ 38-355. Special event permit.

  • (a)

    Special event permit. The operators of an establishment or their agents or employees may knowingly permit any minor to remain upon the premises of said establishment between the hours set forth in Section 38-351 if the establishment has received a special event permit issued by the Village under this Section 38-355.

    (b)

    Special event permit application. Any operator of an establishment seeking to obtain a special event permit shall submit an application to the Village at least ten but not more than 30 days prior to the date of the special event. The application shall include, at a minimum, the establishment's name, address and telephone number, a description of the event, and the name, address and telephone number of each of the establishment's operators. For purposes of this Section 38-355, operator shall mean any person who has at least a five percent ownership interest in the establishment.

    (c)

    Fee. Each applicant shall tender with its application a nonrefundable fee in an amount established from time to time by the Village Board.

    (d)

    Issuance of special event permit. The Village, at its discretion, shall decide whether or not to approve a special event permit application. The Village shall notify the applicant whether a special event permit will be issued at least three days prior to the date of the special event.

    (e)

    Scope and duration of special event permit. Any special event permit issued under this Section 38-355 shall apply to a single event that shall not exceed eight hours.

    (f)

    Maximum number of special event permits. No establishment or operator shall be issued more than ten special event permits in a 12-month period.
