§ 50-51. Duty to remove garbage.

  • (a)

    Preventing excess accumulation. Any person owning, occupying or leasing any premises in the Village shall cause to be removed from said premises all garbage as often as necessary to prevent any excessive or unauthorized accumulation.

    (b)

    Excess accumulation; abatement. A person shall not permit garbage to accumulate on any property within the Village for more than ten days. If garbage accumulates in violation of this Subsection, the Village's Ordinance Enforcement Inspector or such other person designated by the Village may give written notice to any person violating this Subsection that the garbage must be properly disposed of within seven days of the date the notice was mailed. The notice shall be sent to the address that the most recent tax bill was sent and if different, the street address of the property.

    (c)

    Failure to dispose of excess accumulation. If the garbage is not properly disposed of after the notice was sent in accordance with Subsection (b) of this Section, the Village may provide the removal of the garbage and may collect from the property's owner of record the reasonable cost of the removal. If unpaid, this cost shall be a lien on the property as set forth in Section 11-20-13 of the Illinois Municipal Code (65 ILCS 5/11-12-13).
