§ 50-82. Requirements for garbage collection licensees.

  • (a)

    Fees and contracts. A licensee will contract directly with residents and businesses for their services. The Village will not collect fees nor accept payment on behalf of a licensee.

    (b)

    Insurance. A licensee shall maintain the following insurance coverage for the period of the license:

    Type of Insurance Minimum Policy Limits
    Public liability and property damage: $ 1,000,000.00
    Motor vehicle: 300,000.00

     

    The licensee will submit to the Village President current proof of coverage upon request. The licensee will maintain worker's compensation coverage as required by the laws of the State.

    (c)

    Exercise of care. A licensee shall exercise care in handling garbage containers. The licensee shall replace containers in an erect position with lids on the containers.

    (d)

    Nature of service. A licensee's duty to collect, remove, and dispose of garbage shall extend only to material placed and stored in accordance with the requirements of this Article.

    (e)

    Equipment. All garbage must be collected and hauled in modern, leak-proof, packer-type trucks. The licensee shall be responsible for cleaning up all materials spilled by its employee or spilled from its trucks. Every vehicle operated by the licensee in the Village shall be conspicuously marked with the name of the licensee and be maintained in good mechanical condition.

    (f)

    Compliance with law. A licensee must comply with all laws, ordinances, rules and regulations governing the collection, removal, and disposal of garbage.
